THE FOLLOWING TERMS AND CONDITIONS ("TERMS") APPLY TO YOUR USE OF AND ACCESS TO THIS WEBSITE AND THE CLIENT GALLERIES HOSTED VIA PIXIESET, WHICH ARE OWNED AND OPERATED BY RAUL MONTOYA PHOTOGRAPHY ("WE," "US," OR "OUR"). THESE TERMS REPRESENT A LEGALLY BINDING AGREEMENT BETWEEN YOU (THE "USER") AND RAUL MONTOYA PHOTOGRAPHY REGARDING YOUR USE OF THE WEBSITE AND SERVICES PROVIDED. BY ACCESSING OR USING THIS WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

1. ELIGIBILITY

You may use this website and access client galleries if you are at least 18 years old. If you are under 18, you may only use the website with the express consent of a parent or legal guardian.

2. SERVICES

2.1 CLIENT GALLERIES

Raul Montoya Photography provides access to private, password-protected galleries for clients via Pixieset. These galleries allow clients to view, download, and/or purchase digital or printed images.

2.2 PHOTOGRAPHY SERVICES

We offer professional photography services, including but not limited to engagements, weddings, maternity, and portraits. All services are subject to individual agreements.

3. ACCOUNT ACCESS AND SECURITY

You will receive a unique gallery link and password to access your images. You are responsible for maintaining the confidentiality of your credentials and preventing unauthorized access. Do not share your gallery link or password with unauthorized individuals.

4. PAYMENTS AND REFUNDS

4.1 DIGITAL PURCHASES

Payments for digital downloads, prints, and other products are due at the time of purchase. We accept major credit cards and payment platforms (e.g., PayPal).

4.2 REFUNDS

All sales for digital products, including downloads and prints, are final. Once delivered, no refunds will be provided.

5. INTELLECTUAL PROPERTY AND USAGE RIGHTS

5.1 OWNERSHIP

All photographs remain the exclusive property of Raul Montoya Photography, even after purchase or delivery.

5.2 LICENSE TO USE

Clients are granted a limited, non-exclusive, and non-transferable license to use their images for personal, non-commercial purposes, including:

• Sharing on personal social media accounts.

• Printing for personal use.

5.3 RESTRICTIONS

Clients may NOT:

• Edit, alter, or manipulate images without written permission.

• Use images for commercial purposes, including resale or distribution.

• Remove watermarks or credit markings.

5.4 CREDIT ATTRIBUTION

When posting images online, you must provide proper credit to Raul Montoya Photography by tagging or referencing @RaulMontoyaPhotography.

6. LIMITATION OF LIABILITY

We are not responsible for:

• Service interruptions or technical issues on the Pixieset platform beyond our control.

• Loss, deletion, or corruption of files after they have been delivered.

• Unauthorized access to client galleries resulting from your failure to protect passwords.

Galleries may be disabled or removed after a set time frame, as stated in your service agreement.

7. PRIVACY POLICY

We value your privacy. Please review our Privacy Policy for details on how we collect, use, and protect your information.

8. TERMINATION OF ACCESS

Raul Montoya Photography reserves the right to disable or delete client galleries after 3 months unless an extended agreement has been reached.

9. DISPUTE RESOLUTION

Any disputes or claims arising from these Terms will be resolved via binding arbitration under the rules of [Insert Arbitration Organization] and governed by the laws of the State of [Insert State].

10. MODIFICATION OF TERMS
